A Girl Rescued from Being Given in “Baad” in Exchange for Peace and Conflict Resolution in Dushi District of Baghlan Province

Following intervention by officials of the Ministry for the Promotion of Virtue, Prevention of Vice, and Hearing of Complaints of IEA, in a family dispute in Dushi District of Baghlan Province, a prior agreement between two families to give a girl in exchange for peace and settlement of the dispute was terminated with the presence and consent of both parties.

The case was reviewed after a serious dispute arose between the two families following an alleged rape incident. To resolve the dispute, the parties had agreed that a girl from one family would be given to the other family as part of a peace settlement.

After the Ministry’s officials were informed of the matter and reviewed the case and heard statements from both parties, it was found that no marriage contract had been concluded with the girl in question and that the families had only reached an agreement concerning the settlement of the dispute and the giving of the girl in (Baad).

Officials of the Ministry for the Promotion of Virtue, Prevention of Vice, and Hearing of Complaints in Dushi District reviewed the matter in accordance with Islamic Sharia and the directive of Decree No. (83 J 1) issued by the Supreme Leader concerning the protection of women’s Sharia rights.

With the consent of both parties, the previous agreement was terminated, and the girl was rescued from being given in bad.

During the proceedings, emphasis was placed on preserving human dignity, Sharia rights, and the girl’s freedom of choice.

Both families were advised that no pressure, threats, coercion, or harassment should be directed at her in the future.

The parties were also informed that responsibility for the crime of rape rests with the perpetrator, and that giving another girl in exchange cannot replace addressing the original case or holding the perpetrator accountable for the crime.

At the conclusion of the proceedings, the Ministry’s officials emphasized adherence to Islamic Sharia, ensuring the Sharia rights of women and girls, preserving their dignity, and preventing any agreement that could result in the violation or deprivation of their rights.
